Is it to be expected that EAPI=4 ebuilds support EAPI=3?
For example mail-mta/postfix/postfix-2.8.6.ebuild has "EAPI=4" in it but does not use ${ED} so it really doesn't support EAPI=3.
Is that a bug or not?

Not a bug. An ebuild need not use a particular EAPI supported variable to be compliant with a particular EAPI level. It just needs to not use anything that's not supported.
