|
|
When googling (or ddg-ing) a problem related to Gentoo today, I was served an advertisement for this site:
https://www.gentoomedia.com
This is a company calling itself Gentoo Media Inc., incorporated in Malta. They seem to be doing various behind the scenes services for online gambling operations (or maybe they are even running online gambling themselves, I don't know). According to their own website, they took on the name "Gentoo Media" only very recently on 2024-09-25. Here are some screenshots:

Questions:
Isn't that some blatant trademark infringement?
Shouldn't the Gentoo Foundation or the Förderverein Gentoo e.V. do something about this? |

Hi,
so far as I know, if that's not in the IT field, Gentoo could not say anything.
Ubuntu Cola exist for decades, without a single issue.
In the other way, the metal band «Rhapsody» has to change his name because another Italian company working in the music field has the same name, so they added «of fire» (the band) to their name after a law suit.
Also, that should be depending on which country both party are. Try to sue a Russian or Chinese company from Europe as an example… won't get you anywhere I guess.

What are the many uses of Unix in your life? Quote: | Unless you are as powerful as Disney, Coca-Cola, or the Olympic Committee, worldwide and universal trademarks don't exist; the same name can often be used in trade for completely different things. Details depend on the country, the category of goods offered, and of course the tenacity and wealth of the trademark holder. | https://www.bell-labs.com/usr/dmr/www/otherunix.html _________________ Quis separabit? And, yet:

In the UK at least, there's little consistency in how far courts are willing to accept that trademark protection extends. So far as I know, Easy Group isn't involved in driveway cleaning. But it's difficult for a self-employed driveway cleaner to take on a behemoth like Easy Group in court.
Trademark litigation is for those with deep pockets and, even then, it seems to be as predictable as roulette.
