Chroot SSH fails [solved]

Been fighting with chroot and ssh, after having a correctly setup a chroot, ssh to a chrooted user would ALWAYS fail with:
Read from remote host localhost: Connection reset by peer
Connection to localhost closed.

Nothing usefull would be put in the logs even with debug3 turned on.

Using the patch found at: https://bugs.gentoo.org/show_bug.cgi?id=72987 fixed the problem. Comparing the 2 patches it looks like the gentoo patch is incomplete.
