Hi Folks,
The caretaker of my apartment building wants to offer basic internet service to tenants as part of the monthly rent. Ive been consulting with him and weve tested a wifi network throughout the building, no problem there.
We are looking at using a broadband connection from Comcast for the ISP, but their AUP is pretty clear about prohibiting this. The other issue is liability. Does anyone know the legal ramifications if someone did something illegal? Would a general disclaimer signed by the tenant protect the building?
Here are two relevant sections of Comcast's Acceptable Use Policy. Users are prohibited from:
1. Reselling the Service or otherwise make available to anyone outside the Premises the ability to use the Service (i.e. wi-fi, or other methods of networking), in whole or in part, directly or indirectly, or on a bundled or unbundled basis. The Service is for personal and non-commercial use only and you agree not to use the Service for operation as an Internet service provider or for any business enterprise or purpose, or as an end-point on a non-Comcast local area network or wide area network.
2. Connecting multiple computers behind the cable modem to set up a LAN (Local Area Network) that in any manner would result in a violation of the terms of this Policy or an applicable Service plan.
As I understand, the Acceptable Use Policy is written to protect Comcast from liability, and that the company doesn't want to be in the business of policing wireless networks beyond the cable modem.

I've looked into their business plans, and they have pretty much the same AUP. I was just curious if anyone had similar experiences, or knew about the liability issues. Thanks, though. |
