Fantastically.... I managed to copy pete's xorg.conf... I then some how managed to edit it CORRECTLY!!! :D (i am a noob remember)

Was very worried when X didnt start on reboot... then noticed I had an extra ENDSECTION in there :oops: oops!

Removed that .... rebooted.... AND!!!! It's still the same :(

So to recap on the issue....

Kernel.... ok
Ati drivers... installed
xorg enviroment.... updated
Fglrx... loaded
xorg.conf... present and correct

But X is STILL using the mesa project drivers!!!

This is a bit of a doozie!!! :P

the only thing you can do to stop X from using mesa drivers is
Code:
eselect opengl set ati

then run
Code:
eselect opengl list

and check which driver is selected

your xorg-server use flags should be like these for fglrx drivers

These are the packages that would be merged, in order:

so recheck your flags you should have dri, xorg in USE flags and fglrx in VIDEO_CARDS

All that was fine anyway... Its probably just a problem with this version... I guess it will get updated at some point :(
