Kernel 2.6.8-gentoo-r7 + orinoco + monitor mode

In order to enable monitor mode with this kernel, is the perferred method to patch the drivers in the source tree (/usr/src/src/linux/drivers/net/wireless) using the patch found here?

I understand the savanna (link at http://www.nongnu.org/orinoco) drivers now support monitor mode by default (allegedly using "iwconfig <device> mode monitor"), but I have not been able to confirm this. Some programs seem to think that they are unable to set monitor mode with the latest driver.

For compatibility reasons (with kismet and airsnort, mainly), I am resorting to the above diff. Is this bad?

I have always patched the kernel and never had problem, neither with kismet or airsnort.
