The above patent is for updating your computer over the World Wide Web. Gentoo doesn't use www to update your computer, it uses other internet protocols.

MS uses WWW on it's update process though, so I'm sure they'll be a target for extortion.

Gentoo is fine. According to the abstract text of the patent itself:

A technician accesses the World Wide Web through a user's computer. The information resident on the computer, including information regarding the computer and the user's preferences, are downloaded to a remote storage medium through the World Wide Web. Once downloaded, all information may be removed from the user's computer. Subsequently, the technician accesses another computer such as, for example, a new computer that has been assigned to the same user. The technician accesses the World Wide Web through the new computer and downloads the information previously stored on the remote storage medium. This information can then be used to install the user's prior applications, settings and preferences on the new computer.


Basically, this is copying a user's setup on one computer to a new computer using a remote system and the WWW as the medium. That is not what emerge does at all. Gentoo's portage system is designed for updating the same computer. Read the abstract again if it's still not clear.

Also note that if the setup preferences are not uploaded to the remote server via the WWW, but are instead copied directly to the new computer before downloading the appropriate applications to acheive the same setup on the new computer, then the patent isn't violated.

And BTW, yes, I am a lawyer (going on 14 years now). :)
